Please find my terms and conditions which are to represent the interest of both parties, the client (named on the booking form) and Nicola Hesketh the photographer at Image Paradise.

The details of the wedding are to be agreed beforehand in writing (email is acceptable). The client must notify the photographer of any changes to these details also in writing.

Please make sure that you have read and clearly understood all terms and conditions before sending over your booking form. Once payment of the booking fee has been made the client is deemed to have accepted all terms and conditions and these terms will represent the full agreement made between both parties and therefore cannot be altered.

Booking Fee/ Deposit:

To secure your wedding date a deposit of £200.00 is required upon booking. Dates are only reserved when this money has been received in full. An unconditional refund policy exists for a period of 14 days from receipt of payment after this period the deposit is non transferrable and non refundable.

Balance Payment: 

Following the booking fee the full remaining balance is due to be paid 30 days prior to the agreed reserved wedding date. If payment is not received within this time the photographer and Image Paradise reserves the right to not provide any of the agreed services until full payment is made or can ultimately deem the agreement to be cancelled altogether.

Payment for any additional albums, prints or canvases can be made after the Wedding or at the time of the order.


In the unlikely event the Photographer cannot attend your wedding due to unforeseen circumstances (e.g. ill health). A substitute photographer may be appointed to attend your wedding and undertake the photography to his/ her best ability or alternatively a full refund can be offered instead.


All image sizes are nominal. The photographer will provide a pleasing colour balance but cannot guarantee exact colour matching owing to anomalous reflectance caused by a combination of certain dyes and materials especially man-made fibres. It is sometimes impossible to record on film or digitally the exact colour as seen by the human eye.


All images will be adjusted for exposure, brightness, contrast and sharpness. The photographers judgement regarding these corrections and the number of images put forward to the client for viewing shall be deemed correct. Any Retouching, digital manipulation and artist finishing is available to the client as an optional extra.


Final images are expected to be added to your gallery within 6-12 weeks from the event date but times can vary during peak periods.  The online viewing gallery will be active for a minimum of 12 months after initial delivery. Unlimited downloads are included within this time but after the 12 months has expired it is your responsibility to keep hold of the images. Image Paradise cannot guarantee to keep or supply further copies after this time.


The copyright Design and Patents Act assigns the copyright of the images to the photographer. Any images or copies of images whether stored digitally or otherwise and any computer program including any source or object code, computer files or printed documentation relating to such images are protected by the Copyright and Design Act 1988. It is contrary to the Act to copy or allow to be copied photographically/ electronically or by any other means an image created as part of this contract without the permission of the photographer/s in writing.

Creative Licence 

The photographer shall be granted complete artistic licence including in relation to the posses photographed and the locations used. The photographer/s judgement regarding the locations/ poses and number of images taken shall be final. Due to the vagaries of the weather and the willingness of subjects it may not be possible to capture all the images requested.


The clients hereby allow the photographer to display any photograph covered by this contract and to generally promote the business in advertising, brochures, magazine articles, websites, social media, sample albums etc.

Force Majeure or Act of God

The due performance of this contract is subject to alteration or cancellation by either party owing to any cause beyond their control. Although all equipment is checked regularly and reasonable steps are taken to ensure backup equipment is available, the photographer will not be responsible for photographs that are not produced due to technical failure.

Limitation of Liability

In the unlikely event of total photographic failure or cancellation of this contract by either party or in any other circumstance the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss.


The Client may cancel this contract at any time by giving written notice to the photographer but in doing so shall forfeit any monies paid. Cancellation less than 4 weeks before the wedding will result in the payment in full still becoming due. The sum shall be payable as compensation to the photographer for loss of earnings they would suffer, however if another wedding is undertaken for your cancelled date then no further money would be due. 


Any complaints should be raised by the client with the photographer in writing, within 28 days of receiving the images.
